These Terms and Conditions regulate the access, use, and booking of services on the website https://kayakfishinglanzarote.com. By using this website or submitting a booking request, you agree to these terms in full.

2. Nature of Services and Bookings
    • Information Only: This website provides information regarding kayak and shore fishing guided experiences and allows users to request a booking.
    • No Upfront Payments: We do not collect credit card details or take payments upfront through the website.
    • Booking Confirmation: Submitting a form or sending a WhatsApp message does not guarantee a booking. A booking is only finalized once the Owner manually confirms the availability, date, and time with you.
    • Payment Method: All payments are handled directly with the Owner at the time of the excursion by cash or Credit/Debit card option.

 
3. Cancellation, Refunds, and Weather Policy
    • No Refunds Needed: Because no payment is taken in advance, there are no refund procedures or cancellation fees. However, we kindly ask clients to give us as much notice as possible if they cannot attend.
    • Weather and Safety Monitoring: Safety is our highest priority. We monitor marine and weather conditions multiple times daily to ensure it is completely safe to launch kayaks.
    • Bad Weather Protocol: If weather or sea conditions are unsafe for kayaks, the excursion will not take place. In this event, we will:
        1. Reschedule your kayak adventure to the next available safe day, OR
        2. Offer you a shore fishing alternative instead, provided the shore conditions are suitable.

 
4. Participant Requirements and Safety
    • Swimming Ability: By booking a kayak fishing activity, you explicitly declare that you are a competent swimmer and do not suffer from any medical conditions that would put you at risk at sea.
    • Safety Equipment: All participants must wear a life jacket (Personal Flotation Device) provided by us at all times while on the water. Failure to comply will result in immediate cancellation of the trip without rescheduling.
    • Personal Property: The Owner is not responsible for any damage, loss, or dropping of personal items (such as mobile phones, cameras, or sunglasses) into the sea during the activity.

 
5. Intellectual Property
All content on this website—including texts, photographs, logos, graphics, and website code—is the property of Jesús Leandro Machin Álvarez or its licensed third parties. It is strictly forbidden to copy, redistribute, or use any images or text without prior written permission.
 
6. Limitation of Liability
The Owner does not guarantee that the website will always be available or free of server errors. Content is for informational purposes only. The Owner is not liable for technical issues or incorrect information entered by the user in the contact forms.
 
7. Governing Law and Jurisdiction
These terms are governed by Spanish law. Any disputes arising from the use of this website or bookings will be settled in the Courts of Las Palmas de Gran Canaria, Spain. If you are a consumer, disputes may be settled in your home jurisdiction courts.
